These Terms and Conditions of Sale and Use (hereinafter, the "Terms") govern access to and use of the mobile application "Le Monde des Énigmes" (hereinafter, the "App").
The App is published by Nathan Collange, acting as a sole proprietor (hereinafter, the "Publisher").
These Terms also govern the sale of digital goods, namely the puzzle packs offered within the App. Downloading and using the App constitutes the user's full and unconditional acceptance of these Terms.
The App offers puzzle packs for sale. These are digital content not supplied on a tangible medium. Each product is described precisely within the App before purchase (number of puzzles, theme, etc.).
Purchases of puzzle packs are made through Apple's App Store in-app purchase system ("In-App Purchase"). The price of the products is the price displayed in euros (€) on the App Store page at the time of purchase.
The user acknowledges and accepts that the transaction is handled exclusively by Apple. The Publisher does not collect, process, or store any payment information. Apple's terms of service and payment terms apply to every transaction. Users are invited to consult them.
In accordance with Article L. 221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium where performance has begun after the consumer's prior express consent and express waiver of the right of withdrawal.
By making a purchase in the App, the user requests the immediate supply of digital content and expressly waives their right of withdrawal. No refund may be requested from the Publisher once the purchase has been confirmed and the content delivered.
All elements making up the App (source code, design, graphics, text, and logos), as well as its content (in particular, the conception, structure, and wording of the puzzles), are the Publisher's exclusive intellectual property.
Purchasing a puzzle pack grants the user a personal, non-exclusive, non-assignable, and non-transferable licence for strictly private use. Any reproduction, representation, distribution, or exploitation of any kind, even in part, is strictly prohibited and may result in legal proceedings.
The Publisher undertakes to use all reasonable means to ensure that the App functions properly. This is an obligation of best efforts, not an obligation to achieve a specific result. The Publisher cannot be held liable in the event of malfunction, bug, service interruption, or incompatibility of the App with the user's hardware.
These Terms are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing an amicable agreement, and in accordance with Article R. 631-3 of the French Consumer Code, the consumer may bring proceedings either before one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or before the court for the place where they resided at the time the contract was entered into or when the harmful event occurred.
